Driver Terms & Conditions

Applies to: Drivers using the Gamu Driver App in Canada

1. Introduction

These Terms & Conditions (“Terms”) govern your use of the Gamu Driver App provided by Gamu Technologies Inc. (“Gamu”, “we”, “us”, or “our”). By registering and using the Driver App, you agree to these Terms.

Gamu connects registered drivers with customers and merchants for delivery services. Gamu does not employ drivers — you operate as an independent contractor.

2. Eligibility & Driver Requirements

To register and remain active as a driver, you must:

  • Be at least 18 years old (some provinces may require 19+).
  • Have a valid government-issued photo ID.
  • Provide a selfie photo during signup (used for safety and fraud prevention).
  • Provide valid vehicle information (type, make, model, and license plate).
  • Provide proof of insurance that complies with your province’s laws.

âť—Note: Gamu does not currently conduct background checks during registration. This may change in future updates.

3. Independent Contractor Status

You acknowledge and agree that:

  • You are not an employee or agent of Gamu.
  • You are fully responsible for your own taxes, insurance, vehicle maintenance, and compliance with local laws.
  • You may choose when and where to accept delivery requests.
  • Gamu does not guarantee a minimum number of deliveries or income.

4. App Usage

  • You agree to use the Gamu Driver App lawfully and respectfully.
  • You must only accept delivery requests you can complete safely and on time.
  • Any fraudulent or inappropriate use of the app may result in account suspension or termination.

5. Delivery Responsibilities

  • You are responsible for collecting the correct item from the merchant and delivering it to the correct customer.
  • You must verify the item, address, and customer details before delivery.
  • You agree to follow all applicable traffic and safety laws.
  • Gamu may monitor deliveries for quality and dispute resolution purposes.

6. Payouts

  • Gamu uses Stripe Connect Express to send payouts to your linked bank account.
  • Payouts are processed weekly (usually every Monday at 4:00 AM PT) for completed deliveries.
  • Delivery fees are typically paid by the customer.
  • Gamu may deduct platform service fees before payout.
  • Stripe’s standard transaction fees also apply.

If your Stripe account is incomplete or under review, payouts may be delayed.

7. Cancellation & Disputes

  • If a driver cancels an accepted delivery without valid reason, penalties may apply.
  • If a customer disputes a delivery (e.g., missing item), Gamu may investigate and adjust payout accordingly.
  • Repeated cancellations, poor delivery behavior, or dispute incidents may lead to account restrictions or deactivation.

8. Taxes

  • As an independent contractor, you are fully responsible for reporting and remitting your income taxes.
  • Gamu and Stripe may request your tax details for reporting purposes.
  • Gamu does not withhold any taxes on your behalf.

9. Account Suspension or Termination

Your driver account may be suspended or terminated if:

  • You violate these Terms or Gamu platform policies.
  • You provide false or incomplete registration information.
  • You engage in fraud, abuse, or unsafe behavior.
  • You fail to maintain valid insurance or required documents.

10. Limitation of Liability

  • Gamu is not liable for delays, traffic issues, personal injury, or damages caused while completing deliveries.
  • Gamu is not responsible for lost earnings due to app downtime or customer cancellations.
  • Your use of the platform is at your own risk.

11. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada.
Any legal disputes will be handled in the courts of British Columbia.
