Purpose
This document outlines the rules, responsibilities, and rights of customers using the Gamu Canada app to order food and gifts across Canada.
1. Your Agreement With Gamu Canada
By using the Gamu Canada app, you agree to these Terms. If you do not agree, please do not use the app.
Gamu Technologies Inc. (“Gamu Canada,” “we,” “our,” or “us”) provides a platform that connects customers to independent local merchants and drivers. Gamu Canada is not a seller, not a delivery company, and does not hold inventory.
2. Who Can Use Gamu Canada
You must:
- Be at least the age of majority in your province or territory (18 or 19 depending on your location).
- Be located in Canada at the time of using the service.
- Provide accurate and current personal and payment information.
3. Ordering Food or Gifts
- You can place orders for pickup or delivery from participating merchants through the Gamu Canada app.
- All payments are securely processed through Stripe in Canadian dollars (CAD).
- Gamu Canada is a 100% cashless platform. No cash transactions are accepted.
4. Deliveries
- Deliveries are completed by independent drivers registered in the Gamu Canada Driver App.
- Gamu Canada does not employ or control drivers. We provide a matching platform only.
- If your delivery address is not reachable, the order may be canceled or returned by the driver.
5. Order Changes & Cancellations
- Before merchant accepts: You may cancel or edit your order within the Gamu Canada app.
- After merchant accepts but before delivery: You must use the in-app chat to contact the merchant. Updates are allowed only at the merchant’s discretion.
- If you cancel after merchant accepts: A cancellation fee may apply.
- If the merchant cancels: You will be refunded in full, and the merchant may face penalties.
6. Refunds
- All payment-related refunds are handled by Gamu Canada support.
- Approved refunds will be issued to your original payment method.
- Stripe’s transaction fees are non-refundable, unless required by law.
- Refund eligibility may vary depending on the merchant’s own store policy (e.g., perishable or custom items may be non-refundable).
7. Disputes
- Merchant mistake (e.g., missing or wrong item): The merchant is responsible.
- Customer mistake (e.g., wrong order): You must contact the merchant before shipping. Updates are at the merchant’s discretion.
- If a dispute cannot be resolved with the merchant, you may contact Gamu Canada Support for help.
8. Receipts & Invoices
- A payment receipt is automatically issued by Stripe upon payment.
- Platform-generated invoices from Gamu Canada may be added in a future update.
9. Fees
The final amount at checkout includes:
- Item subtotal
- Delivery fee (if applicable)
- Tax based on your province
No hidden fees will be added after checkout.
10. Taxes (Province-Specific)
Sales taxes are collected and remitted based on your delivery address:
- British Columbia: GST (5%) + PST (7%)
- Ontario: HST (13%)
- Alberta: GST (5%) only
- Quebec: GST (5%) + QST (9.975%)
- Other provinces/territories: Tax rates as required
Stripe Tax is used to automatically calculate tax at checkout.
11. Prohibited Use
You must not:
- Use false identities or stolen credit cards.
- Harass merchants, drivers, or other users.
- Attempt to avoid payment systems.
- Tamper with the Gamu Canada app or services.
Violation may lead to suspension or permanent ban.
12. Limitation of Liability
Gamu Canada is not responsible for:
- Delays or delivery failures by drivers
- Product quality or freshness
- Mistakes in orders caused by the user
To the fullest extent allowed by law, Gamu Canada’s liability is limited to the amount paid for the affected order.
13. Account Suspension or Termination
Your Gamu Canada account may be suspended or removed if:
- You breach these Terms
- Fraud or suspicious activity is detected
- We are required to do so by legal or regulatory authorities
14. Changes to These Terms
Gamu Canada may update these Terms at any time. Changes will be posted in the app or sent to your email. Continued use of the app means you agree to the updated terms.
